These terms govern the use of this website and the design and development services Fisher Mart Inc provides to its clients. Each project is also covered by a written proposal; where the two differ, the proposal takes precedence.

Fisher Mart Inc is a web design and development company registered in New Jersey, with offices at 45 Carey Ave, Butler, NJ 07405. In these terms, "we", "us" and "Fisher Mart" mean Fisher Mart Inc; "you" and "the client" mean the business or individual engaging us or browsing this website.
Every engagement begins with a written proposal that sets out the pages or deliverables, the fee, the payment schedule and the target dates. Work starts once you accept that proposal in writing and the deposit is received.
The proposal defines the scope. Additional pages, features, integrations or rounds of design beyond what it lists are quoted separately and added only with your written approval. We will not bill you for work you did not agree to.
Projects are quoted at a fixed price. Unless the proposal says otherwise, 50% is due before work begins and the balance on completion, before the site is moved to your live domain. Ongoing care plans are billed monthly in advance.
Invoices are payable within 14 days. Third-party costs such as domains, hosting, licensed fonts, stock imagery, and paid plugins appear in the proposal before you commit to them, and we either bill them to you at cost or buy them in your own accounts.
Each proposal includes a stated number of revision rounds at the design stage. A round means one consolidated set of feedback from you and one set of changes from us.
We ask for written approval of the design before development begins. If you change direction after that point, by asking for a new layout, a different structure, or a rebrand mid-build, we treat the change as additional work and quote it before we start.
You agree to supply text, images, logos and account access reasonably promptly, and to name one person who can give feedback and sign off on our behalf. We give you a list of what each page needs and the date we need it by.
You confirm that you own or are licensed to use everything you send us, and that it is lawful to publish. We rely on that confirmation and cannot check the provenance of client-supplied material.
On final payment, ownership of the delivered design files and custom code for your site transfers to you, along with the domain and hosting accounts, which are registered in your name from the start. You keep your own trademarks, content and data throughout.
We keep ownership of our internal tools, reusable code libraries and working methods, and license them to you as part of the site, without limit and without further fee. Concepts and layouts shown but not selected remain ours. Unless you ask us not to, we may show the finished site in our portfolio.
Most sites rely on services we do not control, among them hosting, domain registrars, content platforms, payment processors, booking tools, email delivery and analytics. We recommend and configure them, and each provider sets its own availability, pricing and terms under an agreement between you and that provider.
We test every site on current versions of the major browsers and on real phones and tablets before launch. For 30 days after launch we will fix any defect in work we delivered at no charge, whether that is a broken link, a form that does not send, or a layout that fails on a supported device.
That warranty does not cover new features, content changes you make yourself, breakage caused by third-party updates, or problems originating with your host. Those are covered by a care plan or quoted hourly. We do not warrant that a site will reach any particular search ranking, traffic level or sales figure.
Timelines assume that feedback and materials arrive when agreed. If a project goes quiet on your side for more than 30 days we may invoice the work completed to date and reschedule the remainder against our current availability.
Either of us may end an engagement in writing. If you cancel, you pay for work completed up to that date and the deposit is not refundable. If we cancel, you pay only for work completed and we hand over the files produced so far.
We treat the business information you share with us during a project, including pricing, plans, customer lists and credentials, as confidential, and we use it only to do the work. We will sign your own non-disclosure agreement on request.
To the extent permitted by law, our total liability arising from an engagement is limited to the fees you have paid us for that engagement. We are not liable for lost profit, lost revenue, lost data or other indirect or consequential loss.
Nothing in these terms limits liability that cannot lawfully be limited.
The text, layout, imagery and code of fishermartinc.com belong to Fisher Mart Inc. You may read, print and share the pages for your own reference. You may not copy the site or substantial parts of it for use elsewhere, or attempt to disrupt, scrape or gain unauthorised access to it. Enquiry forms are for genuine project enquiries; we filter and discard unsolicited marketing.
These terms are governed by the laws of the State of New Jersey, and the courts of Morris County, New Jersey have jurisdiction over any dispute. Before going to court, both sides agree to try to resolve the matter directly, starting with a phone call.
We may update this page as our services change. The date at the top shows when it last changed. An engagement already under way stays under the terms in force when its proposal was accepted.
Write or call us with any question about these terms or about a proposal you have received.
